Terms and Conditions.
Order Acceptance – While we do everything possible to meet delivery requirements, orders can only be accepted subject to delays caused by strikes, deliveries from our suppliers and/or any order conditions beyond our control.
Price – Prices, term and conditions are those in effect at time of shipment and are subject to change without notice.
Payment Terms – Our terms are Net 30 days from date of shipment for accounts established with credit privileges. Past due amounts are subject to a finance interest charge of 2% per month (24% per annum). Any default in our credit terms will jeopardize future credit privileges & payment terms will be revoked without advance notice to the customer. It is the policy of Julian Tile to charge a $50 processing fee for all cheques returned by the bank for non-sufficient funds (NSF).
Freight – All shipments are F.O.B. our warehouse unless otherwise indicated.
Returned Goods – Returned goods will not be accepted without prior consent and will not be accepted after 30 days from delivery. A minimum 20% restocking charge will be assessed on all accepted returns. Returned material must be prepaid, in full original cartons, in saleable condition and accompanied by an original numbered invoice. No returns will be accepted on non-stocked, special order or discontinued items. No Returns on Setting Materials OR any Slabs.
Product Claims – Variations of size, color and shading are inherent of all ceramic, porcelain and natural stone products. No claims with respect to size, color and/or suitability will be made after installation. The purchaser is responsible for the inspection and acceptance of material prior to installation. It is also their responsibility to determine whether any product is suited for any particular installation or purpose. We recommend that our customers determine carefully whether installation conditions and procedures are suitable in any given case as we will not be responsible for chipping, cracking, crazing, shading or loosening from the setting bed, etc.
No claims will be accepted for damaged material after it has left our warehouse. The buyer is responsible for inspection and accepting the material prior to leaving our warehouse, as well as with the final customer prior to installation. If, for any reason, our products are regarded as unsatisfactory, we must be notified prior to installation. No allowance will be made for labor costs or any other charges after material has been installed.
Freight Claims – Delivery to the carrier shall constitute delivery to the buyer regardless of F.O.B. point or whether freight is prepaid, collect or allowed. Claims for merchandise lost, damaged or delayed in transit must be made against the freight carrier by the customer. All claims for shortages must be reported within ten (10) days after receipt of shipment.
Slabs - ALL SLABS ARE FINAL SALE. Slabs must be checked for damage upon receipt and any damage noted on the waybill before the delivery driver leaves. Photos must be taken of any damage and claims will not be accepted after strapping and braces are removed. Check for damage along the top or side of the slabs.
IN NO EVENT SHALL THIS COMPANY BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, NO MATTER WHAT THE CASE.
Exclusions – These Terms and Conditions constitute the sole and entire agreement between Julian Tile Inc. and the buyer. Julian Tile Inc. shall not be bound by any other conditions, either written, expressed or implied; other than those contained herein.
